ACCEPTANCE OF TERMS AND CONDITIONS

 

By using this site (the "Site"), you ("you" or the "End User") agree to the terms and conditions that we ("Voucherlicious" or “Voucherlicious Pte. Ltd”) have provided. If you do not agree to these terms and conditions (the "Terms of Use" or "Agreement"), please refrain from using the Site.

You understand and acknowledge that due to circumstances both within and outside the control of Voucherlicious, access to the Site may be interrupted, suspended or terminated from time to time. You and we are independent contracts, and nothing in these Terms of Use creates a partnership, employment relationship or agency. There are no third-party beneficiaries of these Terms of Use. You may not assign these Terms of Use, in whole or in part, to any third party without our prior, written consent, and any attempt by you to do so will be invalid. Should any part of these Terms of Use be held invalid or unenforceable, that portion will be construed consistent with applicable law and the remaining portions will remain in full force and effect. Our failure to enforce any provision of these Terms of Use will not be considered a waiver of the right to enforce such provision. Our rights under these Terms of Use will survive any termination of these Terms of Use.

 

These Terms of Use, together with the Privacy Policy and any other legal notices published by Voucherlicious on Voucherlicious, shall constitute the entire agreement between you and Voucherlicious concerning Voucherlicious.

 

YOU AND VOUCHERLICIOUS AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO VOUCHERLICIOUS MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

 

You are legally able to accept these Terms of Use. You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use.

 

 General Rules of User Conduct

 

We aim to make the use of our Site a positive experience for all of our Users, so we require that User restrict any and all activity in connection with the use of this Site to that which involves lawful purposes only. Any conduct by a User that in Voucherlicious's exclusive discretion restricts or inhibits any other User from using or enjoying this Site is strictly prohibited. User agrees not to attempt to reverse engineer or jeopardize the correct functioning of the Site, or otherwise attempt to derive the source code of the software (including the tools, methods, processes, and infrastructure) that enables or underlies the Site. User must not upload or transmit any form of virus, worm, Trojan horse, or other malicious code.

 

You acknowledge and agree that Voucherlicious may preserve information and content and may also disclose information and content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms of Use; (c) respond to claims that any information or content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Voucherlicious, its users or the public.

 

The foregoing provisions of this section apply equally to and are for the benefit of Voucherlicious, its subsidiaries, affiliates and its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.

 

Voucherlicious’s Proprietary Rights

 

All materials contained in this Site, including, but not limited to images, illustrations, audio clips, and video clips, are the copyrighted property of Voucherlicious Singapore Pte. Ltd. or by other parties that have licensed their material to Voucherlicious. As between Voucherlicious and you, Voucherlicious is the sole owner of all content on the Site, including without limitation, all applicable copyrights, trademarks, and trade secrets, and other intellectually property rights thereto. Any copying, reproducing, distributing, transmitting, posting, linking, deep linking, or otherwise modifying of this site without the express written permission of Voucherlicious Singapore Pte. Ltd. is strictly prohibited. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights. For purposes of these Terms of Use, the use of any such material on any other web site or networked computer environment is prohibited.

 

Terms of Sale

 

Voucherlicious provides consumers with opportunities to experience products and services from local businesses at a discount (a “Deal”).

 

By placing an order for a given Deal, you make an offer to Voucherlicious to purchase the Deals you have selected on the terms, restrictions and conditions associated with the Deal (such as the Key Details), subject to the initial requirements for that Deal being met. The Deal is not yours until we notify you via email that the requisite initial requirements (such as the minimum number of people have signed up) have been met for a given Deal. The Voucher you purchase is redeemable for goods or services by the seller of such goods and services, hereinafter defined as "Merchant." The Merchant, not Voucherlicious, is the seller of the goods and services and is solely responsible for redeeming any Voucher you purchase. Voucherlicious sells a Voucher that can be redeemed in connection with your purchase of the goods or services from Merchant.

 

You are required to create an account in order to purchase any Deal. This is required so we can provide you with easy access to print your Deals, view your past purchases, view your referral credits earned, modify your preferences, and to ensure permissible use of the Deal.

 

In addition the following rules apply to all Deals:

 

- Merchant Deals may be applied only to merchandise sold by Merchant, and may not be applied to GST, service charges, shipping or handling charges unless otherwise noted.

- No cash value for any Merchant Deal.

- No cash back upon redemption or at any other time.

- The issuing of credit is at the sole discretion of the Merchant unless otherwise required by law.

- If you redeem the Voucher for less than its face value, you will not be entitled to a credit, cash or new Voucher equal to the difference between the face value and the amount you redeemed, unless otherwise required by law. For example, if you paid $60 for Voucher which entitles you to purchase $100 of product and you make a purchase for $80, you will not be entitled to a credit or cash equal to the difference between the $100 face value and the amount you redeemed. You will not have any redemption value.

- Neither the seller nor the Merchant is responsible for lost or stolen Voucher or Voucher's unique reference number.

- Voucher cannot be combined with any other gift certificates, third party certificates, Voucher, or promotions unless otherwise stated.

- Reproduction, sale or trade of this certificate is prohibited unless done so in compliance with the law.

- The Voucher expires on the date specified on the Voucher, except that the Merchant may continue to redeem the unused cash value you paid for the Voucher(which is usually less than the original face value of the Voucher to the extent required by applicable law).

- Any attempted redemption not consistent with these terms and conditions will render the Voucher null and void to the extent prohibited by law.

- Other restrictions may be noted within the Deal.

 

The Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Merchant, as well as for any unclaimed property liability arising from unredeemed Vouchers. Merchant Deals are redeemable in their entirety only and may not be redeemed incrementally.

 

Linked Sites

 

You may be able to link to third parties' Web Sites ("Linked Sites") from the Voucherlicious Site. Linked Sites are not, however, reviewed, controlled, or examined by Voucherlicious in any way and Voucherlicious is not responsible for the content, availability, advertising, products or other materials of any such Linked Sites, or any additional links contained therein. These links do not imply Voucherlicious’s endorsement of or association with the Linked Sites. It is your sole responsibility to comply with the appropriate terms of service of the Linked Sites as well as with any other obligation under copyright, secrecy, defamation, decency, privacy, security and export laws related to the use of such Linked Sites and any content contained thereon. In no event shall Voucherlicious be liable, directly or indirectly, to anyone for any loss or damage arising from or occasioned by the creation or use of the Linked Sites or the information or material accessed-through these Linked Sites. You should direct any concerns to that site's administrator or webmaster. Voucherlicious reserves the exclusive right, at its sole discretion, to add, change, decline or remove, without notice, any feature or link to any of the Linked Sites from the Voucherlicious Site and/or introduce different features or links to different users.

Indemnification against technical issues

User agrees that from time to time, there would be unexpected surges of traffic potentially resulting in slow usage or non-usage of the website or the associated services. Voucherlicious shall not be responsible for issues arising from technical errors. Voucherlicious will attempt to get the site up as fast as possible. In case of a purchase wrongly made, due refunds will be made if the service cannot be claimed.

 

Termination

 

We may change or discontinue the Site at any time without prior notice. We reserve the right to terminate these Terms of Use at our election and for any reason, without prior notice, and these Terms of Use will automatically terminate in the event that you violate any of the terms and conditions set forth below. Sharing this Information will allow a Voucherlicious Merchant to market directly to you should they choose to do so. However, we will only share Personally Identifiable Information with a Voucherlicious Merchant if you engage in an Identification Activity, and then only to the Voucherlicious Merchant involved in that Identification Activity. Please note that we will only provide a Voucherlicious Merchant your information with an opt-in notice to you, in which you will have a chance to choose that Voucherlicious not give the Voucherlicious Merchant your personal information. We specifically disclaim any responsibility or liability for the actions of such Voucherlicious Merchant. While we inform them that they are only permitted to communicate with you for the purposes of the specific promotion with Voucherlicious, we do not have any responsibility for the actions of the Voucherlicious Merchant, and the actions of the Voucherlicious Merchant are not in our control.

 

We may share your information with Authorized Third Party Service Providers. We provide some of our services and products through third parties. As discussed above, you can always choose not to provide information, although it may be required to engage in a certain activity on the Website. As a condition of purchase of our products and services, we will send you Administrative and Promotional emails. We will send you information regarding your account activity and purchases as well as updates about our products and promotional offers.

 

You cannot opt-out of Administrative Emails. "Administrative Emails" relate to a User's activity on the Website, and include emails regarding a particular User's account and requests or inquiries. In contrast to Administrative Emails, however, you do have a choice with respect to Promotional Emails. Promotional Emails advertise our products and services, and/or the products and services of our Advertisers and Affiliates.
